Nuanced Accommodations

Nuanced Accommodations 

Some accommodations require additional course-specific consideration regarding how they can be appropriately implemented. OALA has expertise regarding disability-related barriers, student access needs, and accommodations, while faculty members and academic programs have expertise regarding course structure, learning objectives, instructional methods, and essential academic requirements. Collaboration between OALA, students, faculty, and appropriate academic and departmental administrators is therefore important when questions arise regarding the implementation of a nuanced accommodation.

Accommodation determinations and implementation decisions are made through an individualized process. When course-specific consultation is necessary, OALA considers the student’s disability-related barriers and access needs, the requested or approved accommodation, the structure of the course or program, and any essential academic requirements that may be affected. Faculty and academic and departmental administrators may provide information regarding the academic requirements and learning objectives of the course or program as part of this individualized review.

Approved Accommodations and Course-Specific Implementation

OALA is institutionally responsible for determining a student’s eligibility for disability-related accommodations and the reasonableness of requested accommodations. An approved accommodation may be implemented differently across courses depending on the nature of the barrier, course structure, and essential academic requirements.

Faculty should not independently deny, modify, or discontinue an accommodation approved by OALA. If a faculty member believes that implementing an approved accommodation in a particular course may modify an essential academic requirement or otherwise fundamentally alter the nature of the course or program, the faculty member should contact OALA promptly. OALA will coordinate an individualized review and consult with the faculty member, student, and appropriate academic and departmental administrators as needed.

When an approved accommodation cannot be implemented because doing so would modify an essential academic requirement or otherwise fundamentally alter the nature of the course or program, OALA will work with the student to determine whether an effective alternative accommodation can provide equal access while preserving the essential requirement.

Accommodation Notification and Student Choice

An OALA accommodation notification letter identifies the accommodations for which a student has been approved. Approved accommodations become active when the student requests that OALA issue the appropriate accommodation notification and OALA provides formal notice to the faculty member, office, or Baylor personnel responsible for implementation.

Students may choose whether to use an approved accommodation in a particular course or setting. The presence of an accommodation on an OALA notification does not require the student to use that accommodation on every occasion.

Accommodations are not retroactive and apply prospectively once activated through OALA’s notification process. They do not retroactively excuse prior absences, extend deadlines that passed before the accommodation became active, change grades or other academic decisions based on events that occurred before activation, or otherwise apply to prior academic requirements or activities.

Resolving Questions or Disagreements

OALA encourages faculty to contact our office whenever questions arise regarding the implementation or reasonableness of an accommodation in a particular academic context. OALA will engage in an individualized fact-finding process that considers the student’s disability-related barriers, the accommodation, and the structure and essential requirements of the course or program.

If a faculty member and OALA do not initially agree regarding the implementation or reasonableness of an accommodation, the matter will be elevated through OALA leadership and appropriate academic administration for additional review. When necessary, the matter may also be elevated to the Office of the Provost and the Office of General Counsel for further institutional review.

The goal of this process is to ensure that accommodation decisions provide students with disabilities equal access while preserving essential academic requirements and the integrity of Baylor’s academic programs.
